Family Medical Leave Act Issues

Pennsylvania employers with 50 or more employees are required to comply with the Family Medical Leave Act (FMLA).  Only employees who have been with an employer for at least one year and worked a minimum of 1250 hours in the previous year are qualified.  The FMLA mandates that an employer grant a qualified employee up to 12 weeks off to recover from illness or injury or care for a new child or sick family member. Employers are NOT required to pay employees when they are off on FMLA leave.  However, they are required to reinstate the employee to the same or substantially the same position upon return from leave.  The specifics of the rule are rather complex.
